CAUTION*There is the following CAUTIONARY INFORMATION for Thomas Burton: As speculation he's child of Joseph, Joseph had a male child born 1774-1790 - Email dated 22 Jun 199_ from Greg Burton of Baltimore, . The email notes that he found a record of a Pleasance Burton daughter of Joseph Burton and Constant Legatt. Pleasance Burton b. 4 Nov 1789, married to William Barcrotf [sic] on 7 Jan 1812 in First Methodist Episcopal Church in Baltimore Co MD. Greg descends from Pleasance's sister Cordelia Burton.
     In followup email to Greg he was asked if he knows if Pleasance and Cordelia have a brother or cousin Thomas. They have to be related since they are both in Baltimore and Burtons marrying Barcofts. Since it was not uncommon then for siblings in one family to marry siblings in another family, there is a great likelyhood they are siblings. The answer was "so far all I have found is Cordelia Burton & Pleasance Burton who were sisters. Their parents were Joseph Burton & Constant Legatt. We will need to search for the will of Joseph Burton & Contant Burton to see if it names all the children.1

Military*1814Thomas Burton was in the military: 1814 Drafted from Baltimore Co. MD - Old War IF #12885 Pvt in the Rifle Company commanded by Captain Harry Fouler (Fowler)
     It is noted by Lineages that the index to grave registrations of soldiers buried in Ohio did not list him. An index to War of 1812 pensions listed a Thomas Burton who had been a private in Captain Fowler's Company, but no state affiliation was given, Subsequent aquisition of a copy of the pension confirms it is the right man.2

Deed1854 In 1854 & 1855 received bounty lands in Ohio - Look for the land to help with proof of parentage.

Probate*25 February 1857His estate was probated on 25 February 1857 Probate extract for Thomas: The journal includes mention of Samuel Burton as the administrator, as well as the widow, Hannah, and provides for a $400 bond to be given to Lee S. Burton and Abraham Coleman as sureties. The Final Record (Book A Book A, pp 180-184, FHL Film #894647) is dated 25 Feb 1857 and names heirs: Hannah Burton, widow, Lee Burton, Hannah Burton, Thomas Mallernee, Henry Mallernee, William Mallernee, Lydia A. Mallernee, Ezra Mallernee, Oliver Mallernee, Hannah Mallernee, and John Burton. John Burton resides Wellsborough, Virginia, while the rest are residents of Harrison Co OH. Hannah Mallernee is now married to Thomas Cramblet. Thomas, Henry, William and Lydia Mallernee are minors. Thomas died about 28 July 1856, is personal estate is valued at less than $3. His real estate consists of two land warrants issued by the US to him for services performed as a private soldier in the war with Great Britain declared on the 18th of Jun 1812. 40 acres of land numbered 100740, dated 3 Aug 1854, 120 acres numbered 30887, dated 14 Nov 1855. Both parcels are valued at $176. Widow received $30 as her dower right in these warrants. In addition to probate journal, researcher Dorothea Greer sent copies of some actual pages from the probate file. The actual death date is given in one of those pages.
