(MentionedInProbate) Probate25 February 1857He is mentioned in the probate of the estate of Thomas Burton on 25 February 1857; Probate extract for Thomas: The journal includes mention of Samuel Burton as the administrator, as well as the widow, Hannah, and provides for a $400 bond to be given to Lee S. Burton and Abraham Coleman as sureties. The Final Record (Book A Book A, pp 180-184, FHL Film #894647) is dated 25 Feb 1857 and names heirs: Hannah Burton, widow, Lee Burton, Hannah Burton, Thomas Mallernee, Henry Mallernee, William Mallernee, Lydia A. Mallernee, Ezra Mallernee, Oliver Mallernee, Hannah Mallernee, and John Burton. John Burton resides Wellsborough, Virginia, while the rest are residents of Harrison Co OH. Hannah Mallernee is now married to Thomas Cramblet. Thomas, Henry, William and Lydia Mallernee are minors. Thomas died about 28 July 1856, is personal estate is valued at less than $3. His real estate consists of two land warrants issued by the US to him for services performed as a private soldier in the war with Great Britain declared on the 18th of Jun 1812. 40 acres of land numbered 100740, dated 3 Aug 1854, 120 acres numbered 30887, dated 14 Nov 1855. Both parcels are valued at $176. Widow received $30 as her dower right in these warrants. In addition to probate journal, researcher Dorothea Greer sent copies of some actual pages from the probate file. The actual death date is given in one of those pages.

Deed* Since he had land, the land records were checked for probate clues. After looking at several deeds, it has been determined that Lee's land was in the SW 1/4 of section 3 town 10 range 4 of Harrison County OH. In a so far undetermined way, the land went to his children who sold it to each other in 1883, 1884, and 1885 for prices ranging from $200 to $750. The deed book and page numbers involved are 34-169, 35-119, 35-121, 35-315, and 35-315. From those records, the residences of some of the children were determined, as well as some spouse names.




 
Death*27 May 1882He died on 27 May 1882 at Harrison Co, Ohio. 
Burial*He was buried at Hopedale Cemetery, Green Twnshp, Harrison Co., Ohio, 401908N0805356W, Green Township Cemeteries Vol 5 pg 220 (SLC 977.168/G1 V39g) says: "Died of old age in his 7y d.30 Oct 1862. Since he was alive in 1880, the stone was obviously misread. A local researcher, Dorothea Greer pursued this matter and found "Historical Collections of Harrison County" by Charles Hanna which says: "Lee S. Burton, d. May 27, 1882; 73y." She sent a copy of the tombstone, and though not entirely clear, it's obvious the latter citation is the correct one, and commented "I could not find a stone for Lee S. Burton. I looked on the other side of Ellen Burton's stone. ... looked more ornate ...chalked the stone ... completely surprised when I saw the Burton name show up ... the stone matches what is in Charles Hanna's reading. ... I could really see why our readers missed this stone completely. I think they read Hannah's stone as Lee S. Burton's stone because of the inscription, wife of Lee S Burton".
ProbateHis estate was probated Negative Probate: no death or probate found in Harrison Co OH. In trying to find Lee's death, Lineages report #56 Nov 1996 shows they checked Probate Court Death Records 1867-1941, (FHL Film #894645), Probate Court Probate Journal 1852-1887, (FHL Film #894645), and Probate Court Final Records 1853-1887 (FHL Film #894176), with nothing on him.
