Private, 3rd Co., Middle Bn., Militia, Sep., 1777 [Ref: M-196, T-5:38]. "Martin Houser or Howser" took the Oath of Allegiance before the Hon. Edward Burghess on Feb. 28, 1778 [Ref: T-3:63, L-1:41]. "Martin Houssen" [sic] rendered aid by providing wheat for use of the military in 1781 [Ref: O-412]. "Martin Howser" died testate in 1812 in Montgomery County; his wife Mary had died testate in 1807 [Ref: V-72].1

To have and to hold the said bargained promises unto the said Richard Gatton his heirs executors administrators and assigns for ever and I the said Martin Howsar for my self my executors and administrators the said bargained promises unto the said Richard Gatton his heirs executors administrators and assigns against all manner of persons shall and will warrent and forever depose by those presents. In witness whereof I have hereunto S & S my hand and seal this twenty second day of January in the year of our Lord Seventeen Hundred and Eighty five. Martin Howsar.

Whereas William Harbert now deceased did on or about the twenty ninth day of October in the year one thousand seven hundred and fifty three by indenture mortgage to a certain Henry Threldhold then of Frederick county in the province of Maryland two several tracts of land then situate in said county of Frederick but now in the county of Montgomery the one called "Dunghill" containing two hundred and ninety seven acres of land more or less. The other called "Herberts Chance" containing one hundred acres of land more or less as will more fully appear reference being had to the said indenture bearing date upon the day and year aforesaid the same being duly recorded among the land records of Frederick county aforesaid, and whereas the said Henry Thrildheld being since dec'd and the money secured by the said mortgage not being paid according to the promise in the said indenture contained the aforesaid lands did descend upon John Threldheld and whereas the aforesaid William Herbert is also since dec'd whereby the equity of redemption of and on the said land called Herberts Chance and of and in one hundred and ninety seven acres part of the said land called "Dunghill" descended upon Linny Hopkins of Orange county in the state of North Carolina sister and heir at law to the said William Herbert and one hundred acres a part of the said land called Dunghill hath descended to the said Linney Hopkins and Mary Housar wife of Martin Housar party to these presents as co-partners and heirs of the body of Eleanor Herbert their Mother. And whereas the said Linney Hopkins by her power of attorney bearing date upon the first day of March in the year one thousand seven hundred and eighty seven do authorize and empower the said Martin Houser to manage and take care of her interest in the promises thereby giving to him the said Martin full power and authority to act and do in the promises as to him should seem right and whereas the said John Thredheld and Martin Houser have settled between themselves the said matters in controversy whereby it is agreed between those the said John Threldheld shall assign release transfer and make over to him the said Martin Housar all the interest and claim of him the said John Threlheld of in and to____ole of the lands above described and every part thereof, which he the said John Threlheld hath or might claim from by or unto aforesaid indenture of mortgage or anything therein contained. Located "adjoining and between a tract called Newton, and a tract called Partnership".
     I hereby certify as surveyor for the county aforesaid that I have carefully surveyed and laid out for and in the name of him the said Martin Housar a tract or parcel of land lying and being in the county aforesaid, Beginning at the end of the nineteenth line of tract of land called Newton, and running thence reverse with said line north seventy seven degrees west one hundred and thirty four perches to Watts branch then up the said branch south twenty two degrees east twenty five perches to the sixth line of tract of land called Partnership then reverse with said line south seventy seven degrees east one hundred and twenty night perches and an half perch to the given line of a tract of land called the resurvey on Newton, then by a straight line to the first beginning containing and now laid out for sixteen acres and three quarters of an acre of land to be held by the name of A hot day in September, surveyed the 3d day of September 1801 for Mr Martin Housar. Also I give and bequeath unto my son William Pritchett Houser and his heirs forever one hundred acres of land being part of a Tract called the Dunghill lying and being in the County aforesaid. Also I give and bequeath unto my daughter Eleanor Stevens for and during her natural life one hundred acres of land being part of a Tract called the Dunhill lying and being in the County aforesaid and at the death my said daughter Eleanor, the said land so willed to my daughter Eleanor shall revert to my grand daughter Mary Buchanan Stevens and her heirs forever. Researcher John Howser provided the clue to locating Martin when he said: "I have a Philip Howser and a Christian Howser from Frederick Maryland. They were both in a will of Martin Howser who died in 1812. Philip was a son of Martin. Christian was a grandson. I have notes that Philip had a son Philip. There was no mention of Christian's parents. Another son of Martin William P Howser was my GGGGF. The family was quite religious and seem to have been quite proserous with large landholdings. Later decendants worked for the B&O." He then suggested contacting his daughter for further information.12 
CAUTIONThere is the following CAUTIONARY INFORMATION for Martin Houser (DAR Patriot): Two entirely different Martin Houser families. In 1837, Carroll Co. was created from Frederick Co. (& Baltimore Co.) Although our Martin's various transactions are in Montgomery and Frederick counties, the land of Houser's Choice is in current day Carroll Co. near the Taneytown area.
     Our Martin Houser is not the one who bought and sold Houser's Choice. According to some notes in 1999 by Susan Emma Houser, found in the Historical Society of Carroll County files, there is a Martin Houser whose wife was Margretha who emigrated 1727 on a ship named Molly. In her notes is a page from Houser Hunters Newsletter v.II #4 showing that Martin Houser b.1691 married 1721 Margaretha Schaffer. They moved to Bethania NC. Per various Ancestry family trees, Martin b.1691 also had sons Martin, Michael, George, Jacob, George Peter, and Daniel all born in PA. The family seems to have moved to NC circa early 1760s.
     With all that in mind, it's very likely that our Martin is no relation to the 1691 Martin.
     This would be the 1691 Martin: "The Lancaster county Court directed the Monocacy road, leading from Wrightsville, York, Hanover and Littlestown to Frederick, Maryland, to be opened in 1736. Martin Houser, on the 2d of July 1741, and on the same day of July 1743, took out warrants, which were afterwards assigned to Peter Little, to whom a patent for 311 acres was granted by the Penns, September 18th, 1760." http://files.usgwarchives.net/pa/adams/church/history/st-aloysius-pt1.txt
